Draft for review. This document is being finalised with legal advice and the operating business’s details before DrillTrade’s public launch. Questions? Contact support.
These terms apply whenever you use DrillTrade on the web or in our apps. They’re written to be read: if anything is unclear, ask us.
DrillTrade is an online marketplace where people and businesses list, find, buy, sell, hire and hire out drilling and piling equipment, parts and consumables in Australia. In these terms, “we”, “us” and “DrillTrade” mean the operator of DrillTrade, [business name and ABN to be confirmed].
We provide the marketplace. We are not a party to any sale or hire between traders, and we don’t own, inspect, store, deliver or guarantee the equipment listed.
Browsing is free. Publishing listings and starting new conversations may require a paid membership. Existing conversations, replies, deal confirmations and reviews stay available if your membership ends.
When you list equipment, you confirm that:
You give us a licence to display, resize and promote your listing content on DrillTrade while it’s listed. We may remove or pause listings that break these terms or that we reasonably believe are unsafe or misleading.
Don’t list, or offer for hire:
Second-hand plant. Under work health and safety laws, a business supplying second-hand plant must tell the buyer in writing about its condition and any faults it has found (model WHS Regulations r 199), and plant supplied only for spare parts or scrap must be marked or described as not to be used as plant (r 200). Some plant, such as mobile cranes over 10 tonnes and some pressure vessels, must be registered with the state regulator. Victoria and Western Australia have their own rules. Describing the condition and faults in your listing, and choosing “For parts or scrap” where it applies, helps you meet these duties but doesn’t replace your own written notice.
Offers, counter-offers and hire requests sent through DrillTrade record what you and the other trader have agreed. The agreement is between you and the other trader.
Don’t use DrillTrade to harass, threaten, deceive or spam anyone, to ask for payment in a misleading way, or to share content you don’t have the right to share. You can block a trader at any time; neither of you can then send new messages or offers.
Conversations are private between the two trading accounts. If a conversation is reported, our team may review its recent messages to deal with the report.
You can review a trader after you’ve both confirmed a completed sale or hire. Reviews must be honest and about that deal. Don’t offer or accept anything in exchange for a review. We may remove reviews that break these rules, but not simply because they’re negative.
Nothing in these terms excludes rights you have under the Australian Consumer Law. To the extent the law allows, we provide DrillTrade as it is, we aren’t responsible for the equipment or the conduct of traders, and our liability for a failure to provide our services is limited to supplying them again or refunding membership fees paid for the affected period.
We may pause listings or suspend accounts that break these terms, put others at risk or are involved in fraud. Where it’s safe to, we’ll tell you why and how to respond.
We may update these terms. We’ll tell you about material changes before they take effect, and ask you to accept them where the law requires. These terms are governed by the laws of [state to be confirmed], Australia.
